These Terms of Service (“Terms”) govern your use of the website and the services provided by Marketing Remedy (ABN [INSERT ABN]) (“we”, “us”, “our”). By accessing our website or engaging our services, you agree to these Terms.
1. Our services
We provide digital marketing services including website design and development, eCommerce, search engine optimisation (SEO), social media, paid media and app development. The specific services, deliverables and fees for your engagement will be set out in a proposal, quote or order confirmation agreed between us.
2. Subscriptions, fees and payment
Some of our services are billed as recurring monthly subscriptions. By subscribing to a monthly plan, you authorise us and our payment provider (Stripe) to charge your nominated payment method automatically each billing period until the subscription is cancelled. Prices are in Australian dollars and, where applicable, include or are subject to GST as indicated at checkout. Failed payments may result in suspension of services until payment is resolved.
SEO minimum term
All search engine optimisation (SEO) plans are subject to a minimum commitment of six (6) months from the date of your first payment. SEO is a long-term strategy and meaningful results typically require several months of continuous work. By subscribing to an SEO plan you agree to maintain the subscription for at least six consecutive monthly payments. If you cancel before the end of the 6-month minimum term, any remaining monthly payments for that term become immediately payable. After the initial 6-month term, your subscription continues month-to-month and you may cancel at any time with notice as set out below. This minimum term does not apply to website builds. Ad-management (paid advertising) plans are subject to a separate minimum commitment of three (3) months from the date of your first payment, on the same basis: if you cancel before the end of the 3-month minimum term, any remaining monthly payments for that term become immediately payable, after which the subscription continues month-to-month. Advertising spend paid to Google or Meta is separate from, and additional to, the management fee.
3. Cancellations and refunds
Unless otherwise agreed in writing, monthly subscriptions can be cancelled with [INSERT NOTICE PERIOD, e.g. 30 days’] notice and will end at the close of the current billing period. Fees already paid for the current period are generally non-refundable. One-off project fees and deposits are non-refundable once work has commenced, except as required by the Australian Consumer Law.
4. Your responsibilities
You agree to provide the materials, access and information we reasonably need to deliver the services, and to ensure any content you supply does not infringe the rights of others. Delays in providing materials may affect timelines.
5. Intellectual property
Ownership of deliverables transfers to you on full payment, unless otherwise stated. We retain ownership of our pre-existing tools, processes and templates, and may showcase completed work in our portfolio unless you ask us in writing not to.
6. Results and warranties
We deliver our services with due care and skill. However, outcomes such as search rankings, traffic and leads depend on many factors outside our control, and we do not guarantee specific results. Nothing in these Terms excludes rights you have under the Australian Consumer Law.
7. Limitation of liability
